Drunk driving accident leaves one injured

A drunk driving accident can occur anytime without notice. When one does happen, an unsuspecting driver can be left with serious injuries or dead. Those who survive the accident may face years of strenuous physical recovery and financial hardship as a result of costly medical care. A recent car accident in Nashville serves as an example, and Knoxville residents should take note.

Recently in Nashville, two vehicles collided, leaving one driver injured. The other driver was found to be intoxicated and was arrested for DUI. Though initial reports state the injured driver received only minor injuries, it may take some time for symptoms of a more serious injury to appear.

Regardless of the severity of the injury, a victim of a drunk driving accident can file a lawsuit against the drunk driver. To succeed on the claim, a victim must prove negligence on the part of the other driver, the negligence caused the accident, and the victim's injuries resulted from the accident. When the opposing driver was found to be intoxicated at the time of the wreck, the negligence element is almost certainly apparent.

Once these elements are satisfied, the victim can obtain compensation. This compensation can be applied toward medical expenses, pain and suffering, lost wages, and damage caused to the victim's vehicle. Then the victim can focus on moving past the accident, recovering, and moving on with life.

A successful suit also sends the message that drunk driving will not be tolerated. The criminal justice system serves as a deterrent, but threatening a negligent driver's wallet may be more effective. With their finances on the line, perhaps future drivers will think twice before climbing behind the wheel tipsy.
